Scope
These terms apply to the Blink One glasses, the Blink App and Blink’s AI services (together, “Blink Products”), in addition to the Terms of Use and, for purchases, the Distance Sales Agreement. Your statutory rights as a consumer, including your rights for defective products and under the warranty, aren’t affected by anything here.
What Blink Products are for
Blink is designed for studying and learning, accessibility, translation, reminders and everyday help. Blink doesn’t advertise, endorse or encourage using its products for cheating, getting around exam rules, or any other unlawful or prohibited purpose, and doesn’t publish instructions or methods for doing so.
Ordinary, permitted and prohibited use
- Ordinary use: studying on your own, revising, working through practice questions, translation, reminders and everyday tasks.
- Permitted use: AI assistance in a class, assessment or workplace whose rules expressly allow it, within the limits those rules set. The rules of whoever gives permission prevail.
- Prohibited use: using the device or any AI assistance where the applicable rules don’t allow it, in particular to get, give or pass on unauthorised help during an exam, test, assessment, competition or interview.
Your responsibilities
- Follow the law, exam rules (for example those of ÖSYM, the Ministry of National Education, universities and certification bodies), school, workplace and institutional policies, and the rules of the places you’re in.
- Check in advance whether you may carry or use a connected device, camera or microphone in a particular place, and switch the device off or take it off where you may not. Device behaviour: how Blink One is fully switched off, how its camera light works and which AI features use cloud services are explained in the user guide and on the product page before sales open.
- Respect the privacy of people around you. Recording or filming people secretly or without a lawful basis may be a criminal offence (for example under Articles 133–134 of the Turkish Criminal Code) and may breach data-protection law. Don’t try to cover, disable or get around the light that shows the camera is active.
Prohibited uses
You must not use Blink Products, or help anyone else use them:
- for cheating, academic dishonesty or unauthorised assistance during any exam, test, assessment, competition or interview;
- for fraud, deception or impersonation;
- to record, photograph, identify or track people covertly or unlawfully;
- to bypass, modify or reverse-engineer the products’ safeguards, usage limits or software, except where the law allows;
- in any other way that breaks the law or rules that apply to you.
These terms don’t make a prohibited use lawful or permitted.
Consequences of prohibited use
To the extent the law allows, you’re responsible for the consequences of your own prohibited use, such as an exam being cancelled, disciplinary penalties, criminal sanctions or harm to others. In Türkiye, for example, cheating in an exam run by ÖSYM using a device that transmits sound or images is an offence under Article 10 of Law No. 6114, punishable by one to four years’ imprisonment, and leads to the exam being cancelled and a two-year ban from ÖSYM exams.
AI responses
AI responses can be wrong, incomplete or out of date. Don’t rely on them alone for health, legal, financial or safety decisions. Don’t interact with the device while driving or doing anything that needs your full attention.
What Blink may do about misuse
Where it’s technically possible and the law allows, Blink may restrict, suspend or end access to your Blink Account or to cloud-based Blink services if they’re used in breach of these terms. Any action will be proportionate. Unless the law or security prevents it, we’ll tell you why and let you respond.
We won’t interfere remotely with the device itself, and restricting a service never affects your statutory rights in a product you bought.
Responsibility and liability
Except where our own fault contributed to the harm, or the law provides otherwise, Blink isn’t responsible for the consequences of using Blink Products in breach of these terms, the law or rules that apply to you.
Nothing in these terms limits or excludes Blink’s liability for intent or gross negligence, for death or personal injury, under product safety and product liability law, for warranty obligations, or under consumer protection law. Blink remains responsible for designing its products to be safe under reasonable and foreseeable conditions of use.
